Plaintiffs In IVC Filter Lawsuits Claim The Retrievable Blood Clot Filters Marketed by C.R. Bard, Inc. and Cook Medical are Defective, Leading to Filter Fracturing, Pulmonary Embolism, Inferior Vena Cava Perforations and Other Injuries
More than 1,300 IVC filter lawsuits have been filed against C.R. Bard, Inc. and Cook Medical, Inc. in two separate MDL’s, Southern Med Law reports. According to documents issued by the U.S. Judicial Panel on Multidistrict Litigation, 709 personal injury claims involving C.R. Bard’s Recovery and G2 filters are now pending in the centralized proceeding underway in the U.S. District Court, District of Arizona. ((MDL 2461)
A second multidistrict litigation established in the U.S. District Court, Northern District of Illinois, for cases involving Cook Medical’s Celect and Gunther Tulip retrievable IVC filters now houses 654 claims. (MDL No. 2570)
IVC filters are small wire devices that are implanted into the inferior vena cava to “catch” blood clots in order to prevent the formation of pulmonary embolism. The products at the center of the C.R. Bard and Cook Medical litigations are not intended for permanent placement, and should be retrieved once a patient is no longer at risk for pulmonary embolism.
The U.S. Food & Drug Administration (FDA) disclosed in August 2010 that more than 900 adverse events involving retrievable IVC filters had been reported to its database since 2005. The majority (300 cases) involved device migration, 46 noted embolizations, 70 resulted in perforation of the inferior vena cava, and 56 involved filter fracture. In 2014, the FDA recommended that doctors retrieve IVC filters within 29-54 days, so long as the risk of pulmonary embolism had passed.[fda.gov/MedicalDevices/Safety/AlertsandNotices/ucm396377.htm, FDA, May 6, 2014]

According to a report that aired on NBC Nightly News in September 2015, C.R. Bard’s Recovery filter may be associated with more than 300 serious injuries and as many as 27 deaths. Though Bard never recalled the device, it did stop selling the Recovery product in 2005 – just two years after it came on the market. The Recovery was replaced with the G2 IVC filter, which was purportedly an improvement over the earlier filter. However, a follow-up report that aired on NBC Nightly News in December suggested that the “improved” filter was also beset by problems.
