Essure Birth Control Lawsuits Allege Bayer Failed To Warn of Essure Risks Including Bleeding, Perforation, Unintended Pregnancies, And Hysterectomies.
As Bayer continues its efforts to dismiss Essure birth control lawsuits, the number of filings against Bayer has now reached 3,000 nationwide. Essure side-effects lawsuits allege Bayer failed to adequately warn that its permanent birth control device can cause unintended pregnancies, severe pelvic pain, miscarriages, autoimmune disorders, allergies to nickel, and other serious health complications.
Bayer mentioned in its third-quarter report that the company face some 3,000 Essure lawsuits in the United States, according to Reuters. The number of Essure complaints continue to increase as judges deny Bayer’s requests to dismiss the cases. For instance, in September, California’s Alameda County Superior Court Judge Winifred Y. Smith refused to dismiss 11 Essure cases involving 14 plaintiffs. Due to the number of plaintiffs involved in other Essure cases, Judge Smith created a mass tort for 55 Essure lawsuits involving 900 women. Essure is a permanent birth control system approved by the U.S. Food and Drug Administration (FDA) in 2002. Essure has flexible coils that are inserted into the fallopian tubes. Scar tissue forms around the coils over a three-month period and blocks the tubes to prevent insemination from occurring. Since its approval, Essure has come under fire from users and women’s health advocates who called for the FDA to recall the birth control device.

In November 2015, U.S. Rep. Michael Fitzpatrick, R-Pa., introduced H.R. 3920, also know as the E-Free Act. The proposed legislation requires the FDA to rescind its premarket approval and recall Essure. As he introduced the bill, Rep. Fitzpatrick said the FDA had received more than 5,000 formal complaints about Essure since 2002. The complaints included deaths of at least four women and five unborn children, Rep. Fitzpatrick said.

Court records show that a California federal judge remanded an Essure lawsuit to the Los Angeles Superior Court in November. Bayer claimed the federal court had jurisdiction because the consolidated case involved over 187 plaintiffs from seven different Essure cases. U.S. District Judge Michael W. Fitzpatrick disagreed and said just because the state court consolidated the case in August does not mean that the federal court has jurisdiction.
