As filings of Essure side-effects lawsuits continue to mount nationwide, a federal judge in Pennsylvania will allow certain claims to move forward in five Essure birth control complaints. Including the birth control lawsuits in the U.S. District Court, Eastern District of Pennsylvania, Bayer HealthCare, Essure’s manufacturer, is defending itself against 3,000 Essure complaints alleging that its birth control device causes chronic abdominal pain, unwanted pregnancy, miscarriage, perforation of organs, and other injuries. The five Essure lawsuits in the Pennsylvania federal court were among the first Essure side-effects lawsuits filed against Bayer. U.S. District Judge John R. Padova dismissed a portion of the claims in the plaintiffs’ original complaint. Subsequently, the plaintiffs filed a second amended Essure lawsuit. In an opinion issued on February 21, Judge Padova allowed claims to remain that assert Bayer:
- Failed to confirmed that doctors are knowledgeable hysteroscopists, ensure that doctors monitored their patients following their completion of training, and ensure that the doctors were certified
- Should have withdrawn Essure
- Made two statements about Essure directed only at physicians
- Made certain fraudulent misrepresentations about Essure
Records indicate the Essure side-effects lawsuit filings allege that Bayer negligently failed to ensure that doctors implanting Essure met the U.S. Food and Drug Administration’s (FDA) training guidelines and requirements. Essure is a permanent birth control system approved by the U.S. Food and Drug Administration (FDA) in 2002. Essure’s flexible coils are implanted into the fallopian tubes. Over a three-month period, scar tissue forms around coils and blocks the fallopian tubes to prevent insemination.
In September, representatives from Essure Problems, a grassroots organization, met with FDA officials to discuss getting Essure pulled from the U.S. market. The FDA, however, did not ban Essure, but ordered Bayer to place a black box warning on Essure’s label and told the company to conduct a clinical study to assess Essure’s risk in different groups of women.

Bayer contends in its court papers that it is protected against product liability lawsuits because Essure went through the FDA’s rigorous premarket approval process for medical devices. State and federal judges have denied Bayer’s repeated requests to dismiss Essure lawsuits that allege the device causes abdominal pain, autoimmune disorders, allergies to nickel, heavy bleeding, and even fetal death. Last year, a California state court judge allowed 11 consolidated Essure birth control lawsuits filed by 14 women to continue coordinated pretrial proceedings. In addition to Essure side-effects lawsuits in the United States, Reuters reported the first two Essure lawsuits were filed against Bayer in France in December.
