The number of Bair Hugger warming blanket lawsuits rose from 269 complaints, as of May 16, to 341 complaints, as of June 15, a 26 percent increase, according to statistics from the U.S. Judicial Panel on Multidistrict Litigation (JPML). Judge Joan Ericksen recently allowed plaintiffs to file their Bair Hugger lawsuits directly into the Multidistrict Litigation (MDL). This ruling will make it more convenient and cost-effective for all the parties involved. In December, the JPML consolidated all Bair Hugger lawsuits filed nationwide and appointed Judge Ericksen to manage the MDL. In addition, court documents show a Bair Hugger lawsuits was added to the MDL involving an Illinois woman who had a knee replacement surgery in February 2013. The warming blanket lawsuit alleges the women developed MSRA after the Bair Hugger warming blanket used during surgery caused contaminants to enter her open surgical wound. According to the lawsuit, the woman had to undergo a two-stage revision surgery for her knee over a seven-month period. The complication caused more hospitalizations for her, as well as skin grafts, blood transfusions, and extended home health care, the complaint said. According to 3M’s promotional material, more than 80 percent of hospitals in the United States use Bair Hugger warming blankets to maintain the normal body temperatures of patients during surgery. The Bair Hugger warming system draws in the filtered air of the operating room, passes it through an internal filter and warms that air to the selected temperature. The warmed air flows to a single-use Bair Hugger warming blanket through a hose attached to the blanket, and is then gently dispersed across the surface of the skin. 3M says its forced-air warming system does not cause infection and does not disrupt the air flow in an operating room.
