Bair Hugger Lawsuit Claims Filed Contend The Bair Hugger Forced-Air Warming Blanket Is Defective And Causes Serious Infections In Patients Who Have Hip Or Knee Replacement Or Artificial Heart Valve Surgeries.
A Michigan resident who filed a Bair Hugger lawsuit recently submitted a petition asking the U.S. Judicial Panel on Multidistrict Litigation (JPML) to transfer 14 Bair Hugger cases pending in six different federal courts to the U.S. District Court, District of Minnesota. Leaving it in the hands of a federal judicial panel to decide whether to consolidate Bair Hugger lawsuits that purport warming blankets manufactured by 3M and Arizantthe that are used in joint replacement and heart surgeries can cause serious infections. According to the plaintiff’s petition, the defendants, 3M Corporation and its subsidiary, Arizant Healthcare, Inc., which designs, manufactures, and sells Bair Hugger devices, are located in Minnesota. Since the cases are similar, centralizing the complaints in one court will help to manage discovery more efficiently, and avoid conflicting pretrial rulings, the transfer petition claims. The Bair Hugger lawsuits allege the warming blankets, which helps to control patients’ normal body temperatures during surgery, are defective because the forced-air system lifts bacteria and other contaminates from the operating room floor and into the surgical site. The Michigan plaintiff says in his complaint that he had surgery on his left hip in August 2012 and developed an infection. As a result, he underwent numerous surgical procedures, and the removal of the majority of his thigh muscle, the complaint said.

According to 3M Corporation, the Bair Hugger force-air warming devices have become a standard in hospitals worldwide for the past 25 years. The Bair Hugger warming blanket maintains a patient’s body temperature to prevent hypothermia during surgery. 3M explains filtered air flows through a warming unit that gently and evenly disperses the air throughout the attached blanket, which is isolated from the surgical site by an adhesive strip on the blanket and with surgical barrier drapes.

Court documents indicate that Bair Hugger lawsuit filings are continuing against 3M Corporation and its subsidiary, Arizant Healthcare, Inc. One lawsuit was recently filed on behalf of a Minnesota resident who developed a MRSA (methicillin-resistant Staphylococcus aureus) infection during a revision surgery for a hip implant in which the Bair Hugger warming blanket was used. The Bair Hugger complaint maintains the plaintiff required six surgical procedures over 11 months to treat what proved to be a difficult and persistent deep joint infection. The complaint purports the Bair Hugger warming blanket is defective and accuses Arizant of ignoring concerns about the potential for infection. In addition to pain, suffering and the inconvenience required to finally remove the infection, the plaintiff continues to suffer substantial, permanent physical impairment, including a lack of ability to move freely, the Bair Hugger lawsuit said.
