low-testosterone-drug-lawsuits-therapy-lawyerAs bellwether trial preparations are underway in the U.S. District Court, Northern District of Illinois for low testosterone lawsuits involving the AndroGel testosterone drug, AbbVie, the maker of AndroGel, proposed that the court, rather than plaintiffs’ and defendants’ attorneys, select 32 potential AndroGel lawsuits for trial, according to court records. At a status conference on August 14, plaintiffs’ attorneys disagreed with AbbVie’s recommendation and proposed following the court’s order of having each side select 16 potential AndroGel bellwether cases. U.S District Judge Matthew Kennelly, who is managing the federal testosterone litigation, met with attorneys on August 18 regarding their differences with the AndroGel bellwether case selection process, according to the court docket. Judge Kennelly has taken the matter under advisement and proposed an alternative to the parties’ proposals which he directed the attorneys to discuss, the docket entry stated. More than 2,300 testosterone treatment lawsuits are pending in the Northern Illinois district court, with the majority of the Low Testosterone Drug lawsuits filed against AbbVie. The Low-T drug complaints allege that testosterone products have caused heart attack, stroke, blood clots, and cardiac death in men who have used the medication. Court documents state that low testosterone products are used to treat hypogonadism in men with low levels of testosterone due to a medical condition and not due to the aging process. Testosterone therapy lawsuits began to mount after the U.S. Food and Drug Administration (FDA) began in January 2014 to re-evaluate the safety and effectiveness of testosterone gels, creams, patches and injections. The federal regulatory agency said its review was prompted by adverse event reports and studies suggesting that testosterone drugs caused heart attack, stroke, blood clots and cardiac death among men who use the medication. After evaluating testosterone products for over a year, the FDA announced in March 2015 that testosterone manufacturers would be required to update their product labels to warn of the possible increase risk of heart attack or stroke in patients using testosterone products. The agency also required testosterone manufacturers to conduct a “well-designed clinical trial to more clearly address the question of whether an increased risk of heart attack or stroke exists among users of these products.”

As stated in court documents, a MDL was established in the U.S. District Court, Northern District of Illinois in June 2014 for testosterone lawsuits filed against six makers of testosterone products. The majority of testosterone complaints are filed against the popular AndroGel drug maker and marketer, AbbVie and Abbot Laboratories. Judge Kennelly ordered attorneys for both sides to select AndroGel cases in two categories: thromboembolism clotting injury cases (deep vein thrombosis, pulmonary embolism or other clotting cases) and cardiovascular cases (heart attack). Judge Kennelly scheduled bellwether trials for the AndroGel bellwether cases to begin between October 2016 and April 2017.
