Testosterone therapies are only approved to treat hypogonadism, a condition marked by low testosterone that is related to an underlying medical problem. They are not approved to alleviate low libido and other symptoms associated with age-related drops in the hormone. It is estimated that only 6 to 7 percent of men suffer from hypogonadism. However, between 1988 and 2011, sales of testosterone treatments increased from $18 million to $1.6 billion. From 2001 through 2011, the percentage of men older than 40 who were using these drugs tripled. Testosterone lawsuits allege that the manufacturers of the medications used deceptive marketing claims to drive their sales, and induced many men to use the potentially-dangerous medications in the absence of a true medical need.
In January 2014, the FDA announced that it was investigating the cardiovascular side effects associated with low testosterone therapies after two studies tied the drugs to an increased risk of heart attacks, strokes and deaths in certain men. One of the studies, which was published in the Journal of the American Medical Association (JAMA) in November 2013, found that men who used testosterone supplements were nearly 30 percent more likely to have a heart attack, stroke, or die after three years of use. The second study, which appeared in January 2014 in PLOS One, found that men over the age of 65 and younger men with pre-existing heart disease may face a two-fold increased risk of heart attacks from testosterone therapies.

Since the FDA announced its review, hundreds of testosterone treatment lawsuits have been filed in U.S. courts. Because so many claims were expected, a multidistrict litigation was established in the U.S. District Court, Northern District of Illinois to allow federal testosterone lawsuits to undergo coordinated pretrial proceedings. By January 2015, more than 600 cases had been filed in the federal litigation.
