Yasmin Side-Effects

Yasmin/Yaz (Ocella) birth control pills were approved by the FDA in 2001. With $1 billion in annual sales, Yasmin/Yaz are blockbuster medication products for Germany-based Bayer.

The oral contraceptives contain a progestin called “drospirenone,” and “ethinyl estradiol,” a synthetic estrogen hormone. In April 2012, the FDA issued a directive for manufacturers of birth control pills containing drospirenone to revise their drug safety labels to report that some epidemiologic studies reported as high as a three-fold increase in the risk of blood clots for products containing drospirenone when compared to other products containing progestin. Some examples include blood clots in the:

• Leg (deep vein thrombosis)
• Lungs (pulmonary embolus)
• Eyes (loss of eyesight)
• Brain (stroke)

The most common side effects of taking birth control pills, including Yasmin/Yaz, are:

• Spotting or bleeding between menstrual periods
• Nausea
• Breast tenderness
• Headache

Yasmim/Yaz Lawsuits

More than 10,000 Yasmin/Yaz lawsuits have been filed in the United States on behalf of women who took the Yasmin/Yaz birth control pills and experienced such life-threatening side-effects as heart attack, stroke, deep vein thrombosis, pulmonary embolism, gallbladder disease or death. The Yasmin/Yaz lawsuits contend that Bayer promoted the benefits of the oral contraceptives but failed to disclose the risks of the medications.

Due to the growing number of personal injury and wrongful death lawsuit filings with similar claims regarding Yasmin/Yaz, the U.S. Judicial Panel on Multidistrict Litigation in October 2009 consolidated all federally filed Yasmin/Yaz cases in the U.S. District Court, Southern District of Illinois for coordinated pretrial proceedings. According to court records, the number of cases in the multidistrict litigation (MDL) climbed into the thousands and in 2012, surpassed asbestos as the largest MDL in the United States. Bayer Agrees To Settle Claims

Bayer has agreed to pay about $1.8 billion to settle over 9,200 claims in the United States, the company said in its 2014 third-quarter stockholders report. Bayer has only been settling U.S. lawsuits that claim venous blood clots (deep vein thrombosis or pulmonary embolism) developing as a result of using Yasmin/Yaz birth control pills.

Court records indicate that there are over 3,800 Yasmin/Yaz complaints pending in MDL 2100. U.S. District Judge David R. Herndon, who is managing the Yasmin/Yaz litigation in the Southern Illinois federal court, issued a Case Management Order in December 2014 regarding selection of cases for bellwether trials. According to the CMO, Judge Herndon has selected 33 cases that will go to trial, with the first case scheduled to begin on May 15, 2015. Cases chosen for bellwether trials are representative of a larger group of lawsuits that have similar claims. The outcome of bellwether trials helps the parties involved to predict trends that may occur in cases tried in the future.
