The halt in the sale of Essure in Canada and Finland comes after a declining in sales. Women implanted with Essure have complained the birth control device causes unwanted pregnancy, miscarriages,chronic pelvic pain, bleeding, adult and fetal deaths, and the need to have a hysterectomy to remove Essure. In the United States, Bayer is facing over 5,000 federal and state Essure lawsuits that contend the company misrepresented the safety and effectiveness of its birth control device.

On June 17, The Toronto Star reported that Bayer decided to voluntarily stop selling Essure in Canada over the next few months because of declining sales and “change in patient demand.” Also, Bayer is facing two proposed Essure class-action lawsuits involving 297 women, some of whom in their 20s and 30s said they had to undergo hysterectomies due to complications with Essure, according to The Toronto Star. Similarly, on May 31, Bayer announced in a press release, written in the Finnish language of Suomi, that demand for Essure was low in Finland and the company would stop selling the product on June 25, 2017.

Essure is a permanent birth control system approved by the U.S. Food and Drug Administration in 2002. The small device has two flexible coils that are inserted into the fallopian tubes. Insemination is prevented due to blockage of the fallopian tubes by scar tissue that forms around the coils over three months. After receiving thousands of complaints over Essure, the FDA called for a black box warning in 2016 on the birth control device.

In February, Brazil’s national health agency suspended the sale of Essure. Advocacy groups and politicians in the United States have been urging the FDA to do the same. Since the FDA has not taken that action, H.R. 3920, also called “E-Free Act” was introduced in November 2015 to remove Essure from the market. Another bill, H.R. 5403, was introduced in June 2016. The proposed legislation, called, “Arial Grace Law,” was named after Ariel Grace Burrell, whose stillborn birth was allegedly caused by the failure of an Essure birth control device. The bill is intended to allow victims injured by medical devices to file state and local lawsuits against medical device manufacturers.
