Essure Lawsuits Continue To Purport That Bayer Failed To Warn About Health Risks Associated With Essure Which Allegedly Causes Severe Bleeding, Chronic Pain, Unintended Pregnancies And Other Complications, Southern Med Law Reports.

Essure-Birth-Control-Lawsuits-Southern-Med-LawA North Carolina woman is one of the first in the state to file an Essure lawsuit after suffering excruciating pain and other complications from the permanent birth control device. Essure lawsuit claims have been filed on behalf of women who experienced chronic pelvic and abdominal pain, severe bleeding, unintended pregnancies, perforation of the uterus and fallopian tubes, and death allegedly stemming from Essure.

WFMY News 2, a CBS affiliate in Winston-Salem, North Carolina reported that the 34-year-old woman experienced extreme cramping and pain after having Essure inserted in 2010. The woman said she initially wanted to have a tubal ligation, but her doctor told her Essure was a “perfect alternative” to having her fallopian tubes tied. The woman now has to decide whether to have a hysterectomy due to the complications allegedly caused by the birth control device. She also wants to see Essure taken off the market.

Essure is a permanent birth control system used by over 750,000 women, according to Bayer HealthCare Pharmaceuticals, which produces the product. Bayer promotes the contraceptive as being 99 percent effective at permanently preventing pregnancy. Essure has flexible coils that are inserted into the fallopian tubes during a non-surgical procedure in a doctor’s office. The tubes are blocked by scar tissue that forms around the coils over several months which prevents insemination.

Since receiving FDA approval in 2002, Essure has been heavily criticized by women who have suffered severe side effects from the product. Additionally, the FDA’s process for approving medical devices has come under scrutiny. In November, U.S. Rep. Mike Fitzpatrick introduced legislation that forces the FDA to rescind its premarket approval of Essure and ban the product from the market. Rep. Fitzpatrick also noted that the FDA has received over 5,000 complaints about Essure.

Court records show that Bayer is facing Essure lawsuit claims over Essure. Bayer, however, maintains it is protected against product liability claims over Essue. The Essure lawsuits are filed by women who have experienced side effects such as severe bleeding, chronic pelvic and abdominal pain, and other complications. The Essure complaints contend Bayer failed to disclose the health risks associated with its device and misrepresented the safety and effectiveness of Essure. The Essure complaints further contend the FDA’s premarket approval for Essure is invalid and Bayer should no longer be shielded from product liability lawsuits over Essure.
