Essure Lawsuits Allege Bayer Failed To Warn of Essure Risks Including Bleeding, Organ Perforation, Unintended Pregnancies, And Hysterectomies

Reuters reported that Essure side-effects lawsuits similar to those in the United States were filed earlier this month on behalf of two French women. The plaintiffs will ask that “an expert determine the relationship between the device and the pathologies patients have been experiencing.” Due to the complaints about Essure, the French health ministry began investigating Essure and found that medical complications were the result of “the way the device was implemented.” As a result, Bayer had to rewrite Essure’s leaflet and stricter rules were imposed on how Essure should be implanted, according to Reuters.

Essure is a permanent birth control system approved by the U.S. Food and Drug Administration (FDA) in 2002. Essure’s flexible coils are implanted into the fallopian tubes which are blocked by scar tissue that forms around the coils over a three-month period. Critics of Essure have asked the FDA to recall the birth control device from the market. The FDA instead ordered Bayer to place a black box warning on Essure’s label and conduct a new clinical study to assess Essure’s risk in different groups of women.

Bayer has argued that it should not be held liable for Essure injuries because Essure went through the FDA’s rigorous premarket approval process. In June, House Bill 5403, called, “Ariel Grace’s Law,” was introduced to change FDA regulations and hold manufacturers liable for injuries caused by their high-risk medical devices. The bill was named after Ariel Grace Burrell, whose stillborn birth in June 2015 was caused by the failure of an Essure birth control device.

Bayer said in its third quarter report for 2016 that it is facing about 3,000 Essure side-effect lawsuits in the United States. Court documents indicate that Essure complaints allege the birth control device causes injuries including hysterectomy, perforation, bleeding, and nickel sensitivity from using the birth control device. Some of the lawsuits are pending in Alameda County Superior Court in California where 55 Essure cases were consolidated on behalf of 900 women in September.
