Anvisa, Brazil’s National Health Surveillance Agency, announced on February 17 that it was suspending the “importation, distribution, marketing use and dissemination” of Essure as a measure of health, according to a report in Modern Healthcare. The contraceptive was initially approved in Brazil in 2009. Essure was banned after Avisa officials reviewed medical reports and studies that found the birth control device can cause chronic pain, unwanted pregnancy, perforation and other injuries, according to WRIC-TV, an ABC affiliate in Richmond, Virginia. Anvisa also recalled Essure devices that had already been distributed.

Essure is a permanent birth control system with two metal flexible coils that are implanted into the fallopian tubes. Scar tissue forms around the coil over three months and blocks the fallopian tubes to prevent insemination. Essure was approved by the U.S. Food and Drug Administration (FDA) in 2002.
The FDA faces pressure from advocates who want Essure banned in the United States. So far, the FDA has not banned Essure, but has ordered Bayer to place a black box warning on Essure’s label and conduct a new clinical study to assess Essure’s risk in different groups of women. Advocates were disappointed in the FDA’s move and are pinning their hopes on two Congressional bills. H.R. 3920, the E-Free Act, aims to force the FDA to ban the device. H.R. 5403-Arial Grace Law would amend FDA regulations and hold companies liable for injuries caused by their high-risk medical devices. The bill was named after Arial Grace Burrell, a stillborn baby girl who died in June 2015 allegedly due to failure of Essure.

Bayer has been trying to get Essure lawsuits dismissed that allege the birth control device causes miscarriages, unwanted pregnancies, nickel allergies, organ perforation, pelvic pain and fetal death. Judges, however, have been denying Bayer’s motions to dismiss and have allowed claims to progress. For instance, in September, 55 Essure lawsuits were consolidated in Alameda County Superior Court in California on behalf of 900 women. In February, a Pennsylvania federal court judge allowed certain claims to move forward in five Essure birth control lawsuits.
