Essure Birth Control Lawsuits Allege Bayer Failed To Warn Of Serious Side-Effects, Including Miscarriages, Chronic Pain And Unintended Pregnancies.
A federal judge in Missouri has denied Bayer’s motion to dismiss a state court Essure side-effects lawsuit. The birth control lawsuit was filed by 32 women alleging injuries from Essure. This is the third time that a judge allowed Essure birth control lawsuits against Bayer to move forward in a state court. The Essure lawsuits mounting nationwide allege the permanent birth control device can migrate from its original implanted position and can cause miscarriages, unintended pregnancies, abdominal and pelvic pain, heavy bleeding, and other serious health complications.
In March, the 32 plaintiffs filed a joint Essure complaint in the Circuit Court of the City of St. Louis, Missouri. Bayer, however, removed the case to the Eastern District of Missouri asserting there were questions of diversity and federal issues raised in the complaint. U.S. District Judge Henry E. Autry ruled that the federal questions raised “are not substantial” and remanded the case back to the St. Louis Circuit Court. The plaintiffs allege in their Essure complaint that Bayer’s birth control device is defective and Bayer and Conceptus Inc., the original manufacturer of Essure, hid the risks associated with their device. Essure is a permanent birth control system approved by the U.S. Food and Drug Administration (FDA) in 2002. Essure’s flexible coils are inserted into the fallopian tubes. Scar tissue forms around the coils over a three-month period and blocks the fallopian tubes to prevent conception. Essure was originally manufactured by Conceptus Inc., which Bayer acquired in 2013. Bayer contends in its court papers that it is shielded from product liability complaints because Essure underwent the FDA’s rigorous premarket approval process. Due to the numerous complaints about Essure and calls for banning the product, the FDA directed Bayer to place a black box warning on Essure’s label. The regulatory agency also ordered the company to conduct a new clinical study to assess the birth control device’s risk in different groups of women.

Court documents indicate that two other state court Essure lawsuits are moving forward after Bayer attempted to dismiss the cases. In September, an Alameda County Superior Court judge in California consolidated 55 Essure cases filed on behalf of 900 women. Bayer had argued it was not liable for the plaintiffs’ injuries.
