Essure Birth Control Lawsuits
U.S. District Judge John R. Padova allowed plaintiffs in five Essure birth control lawsuits against Bayer to amend their complaints to include claims of negligent manufacture, negligent risk management, breach of express warranty, negligent training and fraudulent manufacture. Bayer maintains the U.S. Food and Drug Administration (FDA) gave it pre-exemption status, meaning it is exempt from product liability lawsuits over Essure, which has received premarket approval from the FDA. Essure and other medical devices that have reportedly caused serious injuries and death are the focus of a bill sponsored by U.S. Rep. Mike Fitzpatrick (R-Pa.). At a June 8 news conference, the Congressman was “alarmed to hear that Essure has led to the deaths of at least four women and nearly 300 unborn children.” Rep. Fitzpatrick’s bill titled, “Ariel Grace’s Law,” calls for amending the FDA’s review process of medical devices and allows a manufacturer to be sued if its medical device causes injuries or death. The bill was named after a girl whose stillborn birth was caused by the failure of her mother’s Essure birth control device. Congressman Fitzpatrick also introduced a bill that requires doctors and doctor’s offices to report deaths and serious injuries associated with medical devices to the FDA.

What is Essure
Essure is a long-term birth control device made of two bendable metal coils that are inserted into the fallopian tubes, and passed through the vagina, cervix and uterus. The process causes scar tissue to form around the coils over several months, which blocks the tubes and prevents conception. Migration of Essure and breakage of the device were among the most frequent complaints reported to the FDA. The FDA has also received five reports of fetal deaths in women who became pregnant following an Essure implant.
