Federal Judge Orders Selection of Bard IVC Filter Lawsuits For Bellwether Trials


C.R. Bard IVC Filter Lawsuits Claim The Recovery And G2 Inferior Vena Cava Filters Fracture, Tilt, Migrate And Cause Other Complications To Implant Patients.

ivc-filter-lawsuit-attorney-class-action-lawsuits-4The multidistrict litigation (MDL) for C.R. Bard’s IVC filter lawsuits moves forward with the selection of potential cases for bellwether trials. More than 1,280 lawsuits pending in the U.S. District Court, District of Arizona commonly allege that Bard failed to adequately warn that its Recovery IVC filters and G2 IVC filters migrate, break, puncture the heart and lungs, and cause other serious injuries or death to implant patients. U.S. District Judge David G. Campbell issued a Case Management Order on December 13 that directed attorneys for the plaintiffs and defendant to submit a list of eight to 12 cases for bellwether trials. The parties’ response to each other’s case list is due by December 22. After the parties submit their list of potential cases to the court, the complaints will go through case-specific discovery. Inferior Vena Cava (VC) filters are cone-shaped devices implanted into a large vessel called the inferior vena cava which returns blood from the lower half of the body to the heart. The struts or “legs” of the IVC are designed to capture blood clots and prevent them from traveling to the lungs and causing a pulmonary embolism, which can be fatal. The filters can be removed once the threat of blood clots has subsided. IVC filters are implanted in patients who are at risk of a pulmonary embolism and in those who cannot take blood thinners.

Court documents indicate that IVC filter lawsuits are also filed being filed against Cook Medical Inc. and Cordis Corporation. An MDL has been established for Cook Medical’s Celect IVC filters and Günther Tulip IVC filters. in the U.S. District Court, Southern District of Indiana.

Southern Med Law is representing an Alabama woman who died after suffering complications allegedly from Cordis Corporation’s TrapEase IVC filter. According to the IVC filter lawsuit, the woman was implanted with the TrapEase IVC filter in 2009. On September 19, 2014, she went to an emergency room suffering from lower back pain, abdominal pain, nausea. She also reported that her “legs were going numb.” She was discharged later that day. The next day, the woman was found unresponsive in her home and went back to the emergency room by ambulance. She passed away that day due to cardiac arrest.
