Trials To Begin in 2017 For Xarelto Lawsuits Alleging Blood Clots, Brain Bleeds, Stroke And Other Side Effects After Taking The Prescription Blood Thinner.
Four Xarelto bleeding lawsuits have been selected for bellwether trials by the federal judge overseeing the Xarelto litigation in New Orleans. The cases, which involve allegations of gastrointestinal bleeding and brain bleeds, were selected from Xarelto lawsuitsthat allege Bayer HealthCare, which manufactures Xarelto, and Janssen Pharmaceuticals Inc., which markets the blood thinner, failed to adequately warn of internal bleeding, blot clots, hemorrhagic stroke and other potentially dangerous side effects associated with Xarelto. U.S. District Judge Eldon E. Fallon, who is managing the Xarelto litigation in the federal court for the Eastern District of Louisiana, issued an order in August regarding the case selection. Judge Fallon selected two Xarelto bleeding lawsuits involving gastrointestinal bleeding, one case alleging a brain bleed resulting in death, and the fourth case alleging gastrointestinal bleeding resulting in death. According to the court order, the first trial will be held in February 2017 and involves a plaintiff who was prescribed Xarelto in January 2014 and suffered gastrointestinal bleeding that led to hospitalization and several blood transfusions. Xarelto (rivaroxaban) is approved by the U.S. Food and Drug Administration (FDA) to prevent strokes, deep vein thrombosis, pulmonary embolism, and blood clots in patients with atrial fibrillation not caused by a heart valve problem. Two years after receiving its initial FDA-approval, Bayer’s prescription anticoagulant reached blockbuster status by garnering $2 billion in sales nationwide by 2013, according to Xarelto lawsuit claims. Bayer explains that Xarelto is more convenient for patients to use because routine blood monitoring is not required and there are no known diet restrictions as there are for patients who are prescribed warfarin (Coumadin, Jantoven). The FDA considers Xarelto a new generation blood thiner compared to warfarin, a blood thinner that has been on the U.S. market since 1954. However, when it comes to adverse bleeding events, warfarin uses vitamin K as an antidote but Xarelto does not have an approved reversal agent to treat internal bleeding side effects, according to the FDA.

Court documents show that Judge Fallon has scheduled the first two bellwether trials for February and March in the Eastern district court in New Orleans. The third trial is scheduled for April 2017 in Mississippi and the fourth trial is scheduled for May 2017 in Texas at federal courts yet to be determined. Bellwether trials are seen as “test trials” that help plaintiffs, defendants and the court determine the outcome of future trials or consider the possibility of settling other cases pending in the litigation.
