Two months after a multidistrict litigation (MDL) was established for talcum powder cancer lawsuits, the number of new ovarian cancer lawsuit filings has risen to 82 complaints. On October 4, the U.S. Judicial Panel on Multidistrict Litigation (JPML), transferred 11 talcum powder cancer cases filed in 10 federal courts to the District Court in New Jersey. The judicial panel found all the talcum powder lawsuit claims share common questions about talcum products causing ovarian or uterine cancer in women. By November 15, the number of new cases filed into the MDL had climbed to 60, according to the JPML’s MDL statistics report. As of December 15, the report showed 22 additional cases were filed which raised the total to 82. Talc is a soft mineral that consists of magnesium, silicon, hydrogen, and oxygen, according to the U.S. Food and Drug Administration. Talcum powder is popular among consumers because of its absorbency and ability to protect skin. However, talcum powder cancer complaints note that more than 20 epidemiological studies, beginning in the 1970s, have shown a link between talcum powder and ovarian cancer. The lawsuits contend that talc particles migrate to the ovaries from the vagina which, over a period of time, place women at risk for cancer. Johnson & Johnson maintains that there is no link between perineal use of talcum powder and ovarian cancer. Although Johnson & Johnson sold Shower to Valeant Pharmaceuticals in 2012, the company owned the product when plaintiffs used it.
Court documents show Johnson & Johnson faces some 2,500 talcum powder cancer lawsuits nationwide. The majority of cases, are filed in the St. Louis Circuit Court in Missouri where the company lost three talcum powder cancer lawsuit trials this year. In February, the first jury awarded a record $72 million to the family of an Alabama woman who died of ovarian cancer in 2015. (Case No. 1422-CC09012-01) In May, a second jury awarded $55 million to a South Dakota woman (Case No. 1422-CC09012-02) while a California women was awarded $70 million in October.
