Initial Scheduling Conference For Bard IVC Filter Lawsuits Recently Held in Arizona

The first scheduling conference for IVC filter lawsuits filed against C.R. Bard was held on October 29 at the U.S. District Court, District of Arizona. The Bard IVC Filter lawsuits were consolidated for coordinated pretrial proceedings in August. The claims allege that the company’s Recovery and G2 Inferior Vena Cava (IVC) filters are prone to fracture, tilt, migrate or perforate the inferior vena cava (IVC) and cause injuries to patients.

Court documents indicate U.S. District Judge David G. Campbell, who is managing the Bard IVC multidistrict litigation, appointed plaintiffs’ attorneys to leadership positions. Two attorneys will serve as co-lead counsel and coordinate Bard IVC filter lawsuits while 22 attorneys were appointed to a plaintiffs’ steering committee. The parties also discussed IVC lawsuits that are nearly ready for trial. Judge Campbell does not intend to remand those cases back to their original courts, but keep them in the MDL where they will be considered as possible bellwether cases in the future, according to a Case Management Order the judge issued after the scheduling conference. IVC filters are small, retrievable devices implanted into the inferior vena cava (the main vessel returning blood from the lower half of the body to the heart) to catch blood clots and stop them from reaching the lungs and causing a pulmonary embolism. According to the U.S. Food and Drug Administration (FDA), IVC filters are used in patients who are at risk for a pulmonary embolism but cannot take blood thinners or when blood thinners have failed. Since 2005, the FDA has received 921 adverse events reports involving IVC filters fracturing, migrating, components detaching from the device, and perforating the IVC.

Court documents indicate that the 56 IVC filters pending in the MDL allege that Bard failed to conduct adequate clinical testing to ensure that the device would perform safely and effectively for short-term and long-term use. One complaint recently filed against Bard involved a Georgia woman who had a Bard G2 Express filter implanted in February 2008. According to the complaint, the woman discovered in January 2014 that a component of her IVC filter had perforated a muscle in her heart and open-heart surgery was required to remove the piece of broken filter; however, another missing piece was never retrieved and assumed to still be in her body.
