As the number of lawsuit filings over the blood clot filters began to increase, a multidistrict litigation (MDL) was established for C.R. Bard’s Recovery and G2 IVC filters in the District of Arizona. From August 15 to September 15, 200 new IVC complaints were added to the MDL. This raised the total number of lawsuits from 2,363 to 2,563. At the same time, 195 new IVC filter lawsuits were filed against Cook Medical in the U.S. District Court, Southern District of Indiana. The additional complaints increased the total from 2,455 to 2,650.

IVC filters are small, cage-liked medical devices used to capture blood clots and stop them from reaching the lungs and causing a pulmonary embolism. IVC filters are implanted in the inferior vena cava, a large vein that carries blood from the lower part of the body to the heart. IVC filters are implanted in patients who cannot take blood-thinner medications.

Retrievable IVC filters are intended for temporary placement and should be removed once the risk of a pulmonary embolism subside, according to the U.S. Food and Drug Administration (FDA). The FDA advises removing the filters within 29 to 54 days after implantation to avoid the risk of causing patients serious injuries.

The IVC filter lawsuits commonly allege that Cook Medical’ and Bard’s IVC filter are not safe and cause serious injury and death. Plaintiffs also claim that studies have found high failure rates among IVC filters. One study published in 2012 in CardioVascular and Interventional Radiology found that Cook Medical’s Celect and Günther Tulip IVC filters showed some degree of vena cava perforation after just 71 days.
