In a Case Management Order (CMO) issued July 21, U.S. District Judge Kurt D. Engelhardt ordered the parties to attend a settlement conference with a magistrate judge on June 29, 2018. Judge Engelhardt is presiding over the Taxotere multidistrict litigation in the Eastern District of Louisiana. The CMO also requires the parties to submit a Joint Confidential Status Report by July 6, 2018, if a resolution has not been reached by that date. The parties have already selected 10 potential cases for bellwether trials and the first trial is expected to begin on September 24, 2018. Bellwether trials are seen as “test trials” that help plaintiffs, defendants and the court determine the outcome of future trials. Taxotere (docetaxel) was approved by the U.S. Food and Drug Administration in 1996 to treat locally advanced or metastatic breast cancer in women whose previous chemotherapy treatments failed. Taxotere was later approved to treat prostate cancer, stomach cancer and head and neck cancer. Taxotere is part of a family of drugs known as Taxanes which block cell growth by interfering with cell division. Taxanes are widely used as chemotherapy agents. In addition to hair loss, patients taking Taxotere reported other side effects that include gastrointestinal bleeding, infections, nausea and vomiting, anemia, and skin reactions.

According to the Taxotere complaints, hair loss is a common side effect of chemotherapy treatments. However, plaintiffs contend that Sanofi-Aventis did not warn doctors and their patients that hair loss would be permanent after taking a Taxotere chemotherapy treatment. One lawsuit recently added to the Taxotere litigation was filed on behalf of a Florida woman who underwent cancer treatment with Taxotere in November 2007 and continued to February 2008. The woman claimed that her hair never grew back after she stopped the treatment.
