The Mirena IUD was approved by the U.S. Food and Drug Administration (FDA) as a device that permanently prevents pregnancy by releasing a synthetic form of progestin called levonorgestral, directly into the uterus for up to five years. In 2008, the FDA directed Bayer to update the safety label of Mirena to indicate that the IUD can migrate from its original position in the uterus and perforate the uterus, the intestines and other organs. The label also includes a warning that a pregnancy outside of the uterus (ectopic pregnancy), a pregnancy inside of the uterus (intrauterine pregnancy), and infertility may result if perforation occurs. Removing or manipulating the IUD may result in the loss of pregnancy, the safety label says.

Court documents in Mirena IUD lawsuit claims indicate that federally filed Mirena IUD lawsuits have been consolidated in the U.S. District Court, Southern District of New York. Additionally, Mirena birth control complaints filed in New Jersey have been centralized in Bergen County Superior Court. The federal and state lawsuits both allege that women who were implanted with the Mirena IUD suffered serious injuries that include uterine perforation, organ damage, pain, miscarriages, and infertility due to the spontaneous migration of the device from its original position in the uterus. The Mirena complaints accuses Bayer of failing to warn that its birth control device could dislodge from its proper position in the uterus and relocate to other parts of the body and cause damage.
