Mirena IUD Lawsuits Climb, With Filing of Over 300 New Cases Since March

Women who were allegedly harmed by the Mirena IUD continue to seek redress in courts around the country. According to new court document issued on May 7, 2015, at least 2,095 Mirena IUD lawsuits are pending in a multicounty litigation underway in New Jersey Superior Court, Bergen County. In March, the Court reported that the number of filings stood at 1,790 cases, indicating that the litigation has since grown by 305 new lawsuits. (In Re: Mirena Litigation; Case No. 297)

Meanwhile, court filings indicate that the number of Mirena IUD lawsuits pending in the federal multidistrict litigation underway in U.S. District Court, Southern District of New York, is holding steady, with 1,214 claims filed as of April 15th. “More than 300 new cases in just two months represent a substantial increase in Mirena IUD lawsuit filings. According to court documents, the Mirena IUD is a long-acting contraceptive device that releases levonorgestral, a synthetic form of progestin, directly into the uterus for up to five years. All of the women pursuing Mirena lawsuits in state and federal courts are alleged to have experienced serious complications, including uterine perforations, scaring and adhesions, ectopic pregnancies, organ damage, and infertility due to its purported defects. The lawsuits accuse Bayer Healthcare Pharmaceuticals of downplaying the potential for these serious Mirena complications, while at the same time exaggerating the benefits associated with this form of birth control.

The Mirena IUD lawsuit plaintiffs currently being represented by Southern Med Law include an Alabama family who endured the death of a child in 2012, allegedly due to a malfunctioning IUD. Their complaint, which is currently pending in Alabama’s Mobile County Circuit Court, alleges that Mirena failed to prevent pregnancy due to problems locating its strings, which also made the device difficult to remove. This resulted in an intrauterine infection, which led to premature delivery before the baby’s lungs were fully developed. (Case No. 02-CV-2014-902242.00)
