Mirena IUD Lawsuits Continue To Be Filed In State And Federal Courts

The number of Mirena IUD lawsuits pending in state and federal courts rose from 3,200 in October to nearly 3,470 as of November 9. The Mirena IUD pregnancy complaints allege that Mirena’s manufacturer, Bayer HealthCare Pharmaceuticals, failed to warn of the risks associated with the device that includes, infertility, unexpected pregnancy, organ damage, pelvic pain, birth defects, heavy bleeding, and death.

Federal Mirena IUD lawsuits have been centralized in the U.S. District Court, Southern District of New York where 1,151 cases are pending. State lawsuits are consolidated in a multicounty litigation program in New Jersey’s Bergen County Superior Court where, 2,317 cases are pending. According to the Mirena birth injury lawsuits, the birth control device tends to migrate from its original position in the uterus, and may result in a life-threatening ectopic pregnancy (pregnancy in the fallopian tubes instead of the uterus). The Mirena complaints also warn that Mirena needs to be removed in a uterine pregnancy or a miscarriage may occur. Mirena IUD lawsuits are also being filed in other courts. For instance, Southern Med Law is involved in a case in Alabama’s Mobile County Circuit Court in which Mirena failed to prevent a pregnancy because of issues involving the IUD’s strings. According to the complaint, Mirena could not be removed from the mother’s body and remained during the pregnancy. The presence of Mirena caused the mother to develop an intrauterine infection which lead to the baby’s death following a premature rupture of membranes, chorioamnionitis and preterm delivery before his lungs were fully developed. The lawsuit names Bayer, Bay Area Physician for Women, P.C., and two of the woman’s healthcare providers as defendants. (Case No. 02-CV-2014-902242.00)

Court documents indicate that another Mirena IUD lawsuit was transferred in October into the federal Mirena litigation in New York. The complaint involves a California woman whose Mirena IUD spontaneously migrated and punctured her uterus, causing an infection, sepsis, excruciating pelvic pain, and respiratory failure, the complaint said. The woman was hospitalized in March 2015 and underwent surgery to remove the IUD. The Mirena side-effects lawsuit accuses Bayer of failing to warn of the risks associated with its device.
