Southern Med Law reports that Mirena IUD pregnancy lawsuits have begun to move forward in U.S. courts. The Mirena IUD is a long-acting contraceptive device that releases a synthetic progestin called levonorgestral directly into the uterus. Once implanted by a healthcare professional the IUD can remain in the uterus for up to five years. The Mirena label promises that fewer than 8 in 1,000 women will conceive while using the device. However, a growing number of Mirena IUD lawsuits have been filed in U.S. courts on behalf of women who allegedly suffered serious complications, including uterine perforations, due to spontaneous device migration. According to these lawsuits, spontaneous migration allegedly occurs when the Mirena IUD becomes dislodged from the uterus long after it had been correctly inserted by a doctor or other health professional. The device may then migrate, becoming embedded in the uterus. If it perforates the uterus, the IUD may even migrate into the abdominal cavity, resulting in organ damage, scarring and other harm.
A migrating Mirena IUD will also fail to prevent pregnancy. In such cases, a dangerous ectopic pregnancy is far more likely. Even if conception results in a uterine pregnancy, the Mirena IUD will need to removed, which may result in a miscarriage. If the IUD can’t be located because of migration, removal may not be possible. Mirena birth injury lawsuits claim that this places a fetus at risk for serious birth defects and other harm.
Dr. Blaudeau and Southern Med Law are currently representing a family from Alabama in a Mirena birth injury lawsuit who blame the Mirena IUD for their baby’s premature birth and subsequent death. The complaint, which is currently pending in Alabama’s Mobile County Circuit Court, alleges that because of issues involving its strings, the Mirena IUD failed to prevent conception from occurring. Once the pregnancy was discovered, the problems purportedly associated with its string prevented the IUD’s removal from the mother’s body. The lawsuit claims that the presence of the Mirena IUD during her pregnancy caused the mother to develop an intra-uterine infection, leading to the child’s death following a premature rupture of membranes, chorioamnionitis and preterm delivery before his lungs were fully developed. The lawsuit names Bayer Healthcare Pharmaceuticals, Bay Area Physician for Women, P.C., and two of the woman’s healthcare providers as defendants. (Case No. 02-CV-2014-902242.00)
