Mirena is a long-acting intrauterine device (IUD) used to prevent pregnancy, according to court documents. The small, T-shaped birth control device works by releasing a low dose of levonorgestral, a synthetic form of progestin that is used as a contraceptive. Levonorgestral is released directly into the uterus for up to five years. The Mirena implant is inserted by a doctor during an office visit and invasive surgery is not needed. The birth control device was approved by the U.S. Food and Drug Administration (FDA) in 2000 and today, more than 2 million women in the United States use the device, according to the Mirena IUD complaints. Mirena is recommended for women who have had at least one child.
The Mirena complaints allege that the IUD can spontaneously migrate from its original position and perforate the uterus, the intestines and other organs. In 2008, the FDA directed Bayer to update its safety label to warn about the migration risk which can also lead to an ectopic pregnancy (a pregnancy occurring outside of the uterus and usually in the fallopian tubes), an intrauterine pregnancy (a pregnancy that occurs inside the uterus), and infertility, which may result if perforation occurs. According to the safety label, removing or manipulating the Mirena IUD may result in the loss of pregnancy.

New court filings indicate that 1,182 Mirena lawsuits are pending in the U.S. District Court, Southern District of New York, as of July 15, a slight increase from 1,171 in June. (In Re: Mirena Litigation; Case No. 297) Court records show that Mirena lawsuit filings in New Jersey’s Bergen County Superior Court increased by 81 cases, from 2,095 in June to 2,176 as of July 21. Court documents indicate that parties involved in the lawsuits in both state and federal courts are preparing for bellwether trials, which are expected to begin simultaneously in both courts in March 2016.
