Southern Med Law Is Repesening Women In Mirena Lawsuits Against Bayer Alleging Miscarriage, Birth Defects, Pelvic Pain, Bleeding And Other Serious Injuries Due To IUD Birth Control Device.
As pretrial proceedings are underway for 3,200 Mirena IUD lawsuits alleging miscarriage, uterine perforation, and other side-effects, Southern Med Law reports that the July 2 deadline is approaching for attorneys to submit their selections of potential cases for Mirena bellwether jury trials in federal and state courts. Court documents indicate that U.S. District Judge Cathy Seibel, who is managing the federal Mirena litigation in the U.S. District Court, Southern District of New York, ordered the selection of 15 cases – five each from the plaintiffs and defendants and five randomly selected by the court. The Mirena lawsuits filed on behalf of women who believe they have experienced complications from the Mirena IUD implant contend the Mirena intrauterine device is “defective and unreasonably dangerous” and that Bayer Healthcare Pharmaceuticals downplayed the potential risks of their birth control device which include uterine perforations, ectopic pregnancies, organ damage, infertility and pregnancy while using the Mirena IUD due to the effects of the birth control device. Court records for Bergen County Superior Court in New Jersey where Mirena IUD complaints have been centralized, shows similar pretrial proceedings as those in the federal court. Superior Court Judge Brian Martinotti, who is managing the multicounty litigation, ordered both parties to select seven cases each and submit the 14 potential bellwether cases by July 2. According to Judge Martinotti’s order, these cases are expected to be reduced to four by March 2016, around the same time the first bellwether trial is scheduled to begin. Court documents indicate that 1,200 Mirena lawsuits are pending in the New York federal court and 2,095 Mirena lawsuits are pending in the New Jersey state court. The Mirena complaints were filed on behalf of women who allegedly suffered injuries such as perforation of the uterine wall, organ damage, ectopic pregnancy, infertility and other complications due to the birth control device which can spontaneously migrate from its original position in the uterus. The Mirena lawsuits assert that Mirena’s manufacturer, Bayer Healthcare Pharmaceuticals, failed to warn that the intrauterine device could dislodge from its proper position in the uterus and relocate to other parts of the body and cause damage.
