A pregnancy can occur with or without the IUD in its original place of insertion in the uterus. As a result, Mirena birth injuries and health complications can include, but are not limited to, infection, miscarriage in 2nd trimester, premature births resulting in brain-related injuries, pulmonary hypertension, underdeveloped lungs, neural tube defects, and death. The Mirena IUD is made by Bayer Healthcare Pharmaceuticals.

“Bayer promotes its Mirena IUD as an effective contraceptive that lasts for up to five years,” says Dr. Blaudeau. “But many women who use the device may not be aware of the potentially serious injuries that the IUD can cause to them and their babies. This is one of the important legal questions in the Mirena IUD litigation: ‘Did Bayer fail to provide adequate warning about the risks of its Mirena device?’”

According to Bayer, Mirena is an intrauterine device that is over 99 percent effective at preventing pregnancy. The IUD is recommended for women who already have at least one child, which is why Bayer’s promotes Mirena IUD to “busy moms.” The soft, T-shaped, flexible device is inserted in the uterus and releases doses of the synthetic hormone, levonorgestrel, which is used as the contraceptive.

Southern Med Law is currently representing an Alabama couple in a wrongful death lawsuit filed against Bayer due to the death of their infant son in August 2012. The Mirena pregnancy birth injury lawsuit alleges that the intrauterine device failed to prevent pregnancy because its strings could not be located which made it difficult to remove, and this presented a significant risk to the pregnancy. A baby boy was born prematurely on August 4, 2012, but suffered from a right-sided diaphragmatic hernia, pulmonary hypertension, degenerated right pulmonary artery, a large patent ductus-arteriosis (PDA), and persistent fetal oxygenation. The baby died on August 5, 2012, just 36 hours after birth, according to the lawsuit. (Case No. 02 CV-2014-902242.00, Mobile County Circuit Court)

Court documents indicate that more than 3,300 Mirena lawsuits have been filed in state and federal courts in New Jersey’s Bergen County Superior Court and the U.S. District Court, Southern District of New York where the birth control complaints have been consolidated for pretrial proceedings. The lawsuits have been filed on behalf of women who allege that they have experienced such complications as uterine perforations, ectopic pregnancies, organ damage, scaring and adhesions, and infertility due to the effects of the birth control device. The Mirena IUD complaints purport that the intrauterine device is “defective and unreasonably dangerous” and Bayer Healthcare Pharmaceuticals downplayed the risk of its birth control device.
