After the device failed to prevent her pregnancy, the baby’s mother allegedly develop an intra-uterine infection due to the inability of her doctor to retrieve the IUD. The complaint charges that this infection caused the premature rupture of membranes, chorioamnionitis and preterm delivery before the baby’s lungs were fully developed. The Mirena IUD is a long-acting contraceptive device that releases levonorgestral, a synthetic form of progestin, directly into the uterus for up to five years. According to its labeling, fewer than 8 in 1,000 women will become pregnant while using Mirena. However, court documents indicate that a growing number of Mirena lawsuits allege that the IUD is prone to spontaneous migration, which plaintiffs contend can cause a host of complications, including uterine perforations, organ damage, infertility and scarring. A migrating IUD will also fail to prevent pregnancy.
About half of all pregnancies that occur with the Mirena IUD will be ectopic pregnancies, which must be terminated. However, a normal uterine pregnancy is also risky if Mirena is present, and may result in severe infection, miscarriage, ectopic pregnancy, premature delivery and even death. If the pregnancy is to continue, the device must be retrieved, which may result in miscarriage. However, if the Mirena IUD has migrated, locating the device and removing it might not be possible.
