Mirena Pregnancy Lawsuits Allege Bayer Failed To Warn About The Risks Of Miscarriage, Ectopic Pregnancy, And Fetal Death Allegedly Caused By Its Mirena IUD.
Mirena pregnancy lawsuits filed by women who became pregnant while using the Mirena Intrauterine Device (IUD) will continue despite a recent dismissal of Mirena injury lawsuits. The Mirena pregnancy lawsuits moving forward were filed by women who experienced ectopic pregnancy, septic miscarriage, preterm rupture of the membranes, chorioamnioitis, and fetal death while using the IUD birth control.

Last week, U.S. District Judge Cathy Seibel tossed out over 1,300 Mirena injury lawsuits that allege the IUD perforates the uterus after insertion and Bayer failed to warn about that risk. The plaintiffs had expert witnesses to testify in support of their claim but Judge Seibel, in March, granted Bayer’s motion to prohibit the testimony. Bayer maintained there is no evidence Mirena can perforate the uterus after insertion, and a perforation that occurs during insertion may only be detected later, Reuters reported. Judge Seibel, who is managing the Mirena litigation in the Southern District of New York, said a jury would not have a “sound basis” to find in favor of the plaintiffs without the expert testimony. So, Judge Seibel entered a judgment in favor of Bayer on July 28.

Mirena (levonorgestrel-releasing intrauterine system) is a hormone-releasing contraceptive approved by the U.S. Food and Drug Administration in 2000. The soft, flexible, plastic T-shaped IUD is inserted in the uterus to prevent pregnancy for up to five years. Mirena slowly releases levonorgestral, a synthetic form of progestin, directly into the uterus, according to Bayer. Plaintiffs in Mirena IUD lawsuits allege the contraceptive can fail to prevent pregnancies and is prone to spontaneous migration which can cause septic miscarriages, ectopic pregnancies, chorioamnioitis infection, and other serious health conditions, including fetal death.

Mirena IUD causing fetal death is alleged in a lawsuit Southern Med Law filed recently on behalf of a Georgia woman who gave birth to a stillborn baby in April 2013. According to the complaint, the Mirena IUD was inserted in 2009, and the device failed to prevent a pregnancy. Due to the allegedly defective design of the IUD strings and “T”-shaped arms, the IUD became embedded in the plaintiff’s uterine wall which made it impossible to remove, the complaint said. As a result, the Mirena IUD caused an infection which resulted in the woman giving birth in her second trimester to a stillborn boy who weighed 49.3 grams, the wrongful death lawsuit says.
