According to Southern Med Law, All of the Bard IVC Filter Lawsuits Involve Serious Complications Allegedly Caused By Recovery, G2 And Other Retrievable IVC Filters Marketed By C.R. Bard, Inc.
More than 20 Bard IVC filter lawsuits are currently pending in federal courts throughout the country, all of which were filed on behalf of individuals who allegedly suffered serious complications associated with C.R. Bard Inc.’s retrievable IVC filters, including its Recovery and G2 products Court documents indicate that the U.S. Judicial Panel on Multidistrict Litigation (JPML) is scheduled to hear Oral Arguments on July 30th regarding a proposal to consolidate all federal claims involving these products in a single federal court for the purposes of coordinated pretrial proceedings.
“Court documents show that at least 25 Bard IVC filter lawsuits have been filed in 23 separate federal districts. Consolidation of these and future claims in a single jurisdiction would improve judicial efficiency by reducing the possibility of duplicative discovery and inconsistent rulings from different courts,” says Dr. François Blaudeau, the founder of Southern Med Law. The Firm is currently evaluating legal claims on behalf of individuals who allegedly experienced life-threatening complications associated with Bard IVC filters including:
• Perforation of the Heart, Lung or Other Organs
• Hemorrhagic Pericardial Effusion or Other Hemorrhage
• Cardiac Tamponade or Pericardial Pamponade

According to court documents, IVC filters are small devices that are implanted into the inferior vena cava to “catch” blood clots in order to prevent the formation of pulmonary embolism. Plaintiffs in Bard IVC filter lawsuits claim that C.R. Bard’s products are associated with an increased risk of fracturing, titling within the inferior vena cava, perforating the wall of the inferior vena cava (frequently penetrating into other organs and tissues such as the aorta and duodenum) and migrating through the body. They further assert that these devices lack efficacy and may actually increase the risk of pulmonary embolism.
“All of these claims assert similar allegations regarding the safety and efficacy of C.R. Bard’s IVC filter products, and the cases will likely rely on many of the same expert witnesses and much of the same evidence. This suggests that the creation of a multidistrict litigation would be appropriate,” says Dr. Blaudeau.
