A newly filed Bair Hugger lawsuit is alleging the surgical warming blanket led to a knee amputation and the death of a Louisiana woman. According to the Bair Hugger lawsuit filed in the U.S. District Court, District of Minnesota, the plaintiff underwent a left total knee arthroplasty in February 2015 and a Bair Hugger forced-air warming device was used during the revision surgery.
The Bair Hugger lawsuit asserts the warming blanket used during surgery caused contaminants to come into the open surgical wound and the woman developed periprosthetic joint infection. As a result, the woman underwent multi-staged removal and multiple revision arthroplasties and later developed a poly microbial infection that ultimately led to a left knee amputation and led to the cause of her death, according to the Bair Hugger complaint. The lawsuit claims Bair Hugger has a defect in its design and manufacture and the defendants, 3M Company and Arizant Healthcare, Inc., failed to warn about the risk associated with their device. Court documents indicate that all federally filed Bair Hugger lawsuit claims against Minnestota-based 3M Company and its Arizant Healthcare subsidiary have been consolidated in a multidistrict litigation in the Minnesota district court. In December 2015, the U.S. Judicial Panel on Multidistrict Litigation centralized the Bair Hugger complaints for pretrial proceedings. The judicial panel explained that the complaints share common factual issues that include claims that Bair Hugger is defective because it lifts bacteria from the operating room floor and into the sterile surgical site.
