Number of Zofran Birth Defects Lawsuits Continue To Rise Alleging Cleft Lips and Heart Defects

There are now 270 Zofran birth defects complaints in the multidistrict litigation (MDL), up from 260 in June. The Zofran lawsuits accuse Zofran’s maker, GlaxoSmithKline, of improperly marketing the drug as a treatment for morning sickness in pregnant women but failing to disclose that the drug allegedly causes cleft palate, cleft lip, heart defects and other birth defects. Zofran birth defects lawsuits were consolidated in October for coordinated pretrial proceedings. Recently, U.S. District Judge F. Dennis Saylor IV, who is managing the Zofran litigation, made it easier for plaintiffs to file lawsuits into the MDL. A Master Complaint with common allegations about Zofran and a Short Form for plaintiffs were recently created. Plaintiffs will be able to choose allegations from the Master Complaint to include in their Short Form complaints. Zofran (ondansetron) is an antiemetic drug approved by the U.S. Food and Drug Administration (FDA) to treat nausea and vomiting related to chemotherapy and radiation, and when it occurs after surgery. Plaintiffs in the Zofran MDL maintain that the FDA has not approved Zofran to treat morning sickness, which includes nausea and vomiting, in expectant mothers. Yet, GlaxoSmithKline promoted Zofran for that purpose. Plaintiffs also claim GlaxoSmithKline knew about Zofran’s harm to an unborn fetus because animal studies from the 1980s indicated Zofran’s active ingredient could cross the placental barrier and reach the developing fetus. GlaxoSmithKline came under investigation for its marketing of certain drugs, including Zofran, and for its alleged false price reporting practices. In July 2012, GlaxoSmithKline reached an agreement with the U.S. Department of Justice to plead guilty and pay $3 billion to resolve criminal charges and civil liabilities on various claims, including illegally promoting Zofran to doctors and their patients as a treatment for morning sickness. The justice department said this was the largest health care fraud settlement in U.S. history.
