A Physiomesh lawsuit has been filed on behalf of a Florida woman who had an adverse reaction to the hernia mesh and had to undergo multiple surgeries as a result. This complaint is similar to other lawsuits that allege Ethicon Inc.’s Physiomesh Flexible Composite hernia mesh causes implant patients to suffer chronic pain, bowel obstruction, infection, inflammation and other serious complications. According to the recently filed complaint, the Florida woman was implanted with a 15×20 cm Physiomesh Composite mesh in December 2010 to repair an incisional hernia. The hernia mesh failed, however, and the plaintiff had to undergo invasive surgery to have the device removed. The plaintiff underwent another invasive surgery to repair the hernia that the Physiomesh was initially implanted to treat, the complaint said. The lawsuit contends the Physiomesh was defective and Ethicon did not adequately warn or inform the plaintiff or her doctor about the risks associated with the hernia mesh. Physiomesh Flexible Composite Mesh is used in minimally invasive ventral hernia repair. The synthetic device has a unique multi-layer coating which is designed to reduce or minimize adhesion and inflammation and to facilitate incorporation of the mesh into the body. Conversely, Physiomesh lawsuits claim the multi-layer coating prevents adequate incorporation of the mesh into the body and results in serious complications. In May 2016, Ethicon voluntarily withdrew the Physiomesh Flexible Composite Mesh from the global market after unpublished data from two large European hernia registries showed higher rates of revision surgeries and hernia recurrence with Physiomesh compared to similar mesh devices.

Due to the growing number of Physiomesh lawsuits being filed in federal courts nationwide, plaintiffs involved in pending cases are seeking consolidation of all federal Physiomesh Flexible Composite Mesh lawsuits. In March, the plaintiff asked the U.S. Judicial Panel on Multidistrict Litigation to transfer 18 pending hernia mesh complaints, as well as Physiomesh lawsuits filed in the future, to the Middle District of Florida, where six complaints are already filed. The hernia mesh complaints are pending in nine different federal courts but commonly allege that Physiomesh erodes, adheres to internal organs, causes bowel obstruction, abdominal pain and other serious injuries in patients implanted with the device.
