Hernia Mesh Lawsuits Allege The Hernia Repair Device Is Defective And Could Cause Serious Side-Effects and Require Revision Surgery
A a multdistrict litigation (MDL) for hernia mesh lawsuits has been established by a federal judicial. The panel established the MDL for all federally filed lawsuits regarding Atrium Medical Corp.’s C-Qur (pronounced “Secure”) polypropylene surgical mesh patches. Lawsuits filed on behalf of plaintiffs who have had hernia surgery in which the C-Qur or the Physiomesh were used both allege that the products are defective and cause numerous health complications that could lead to further surgeries to remove the hernia mesh devices.
On December 8, the U.S. Judicial Panel on Multidistrict Litigation (JPML) transferred 13 C-Qur hernia mesh lawsuits that were pending in seven federal courts nationwide to the District of New Hampshire. The JPML selected U.S. District Judge Landya B. McCafferty to manage the MDL as the consolidated cases move through coordinated pretrial proceedings. The judicial panel found that all of the lawsuits involved factual questions relating to whether C-Qur mesh was defectively designed or manufactured, and whether the defendants knew or should have known the hernia mesh patch allegedly causes an allergic or inflammatory response. The complaints also share common questions on whether the defendants provided adequate instructions and warnings with the C-Qur mesh. (In Re: Atrium Medical Corp. Atrium Medical’s C-Qur surgical mesh patch is used for permanent abdominal wall reinforcement in patients undergoing hernia repair surgery. The C-Qur polypropylene mesh has an outer coating of gel made from Omega-3 fatty acids (fish oil) and triglycerides which Atrium claims will reduce the risk of complications and allow for better mesh adherence to the abdominal wall. C-Qur lawsuits, however, contend the hernia mesh causes an inflammatory response which can result in the mesh adhering to the bowel and twisting it, which can lead to gastric ulcers and other intestinal problems. The complaints further allege inflammation can cause chronic pain and abscesses. Some plaintiffs have undergone revision surgery to remove the mesh patch.

In addition to Atrium Medical, court records show Ethicon Inc., a subsidiary of Johnson & Johnson, is facing federal lawsuits over its Physiomesh Composite Flexible Mesh. Ethicon voluntarily withdrew the hernia mesh from the global market in May after an analysis of unpublished data showed high rates of hernia recurrence and revision surgeries when the mesh is used for a minimally invasive ventral hernia repair. The Physiomesh complaints allege the hernia mesh causes infection, abdominal pain, and other health complications and the company failed to warn about the risks associated with the device.
