A petition to consolidate all Stryker Femoral Head recall lawsuits has been granted by the U.S. Judicial Panel on Multidistrict Litigation (JPML). In granting the request, the federal panel transferred six Stryker hip recall lawsuits to the District of Massachusetts. The hip replacement lawsuits commonly allege the taper lock failure of Stryker’s recalled LFIT Anatomic CoCr V40 Femoral Heads can cause patients to suffer blood metal poisoning, adverse local tissue reaction, loss of mobility, joint instability and other complications that make it necessary for patients to have surgery to remove the device. Howmedica Osteonics Corporation (HOC), doing business as Stryker Orthopaedics, opposed the consolidation saying there were only a small number of federal lawsuits pending and centralization would not be beneficial since the LFIT femoral heads can be used in a wide variety of hip replacement systems. The JPML rejected Stryker Orthopaedics opposition arguments that there were only a small amount of federal lawsuits, citing there are 33 Stryker cases pending in 17 different districts.
The transfer order further stated the “number of different combinations of sizes and types of stems can be employed with the modular LFIT V40 device is not an insurmountable barrier to centralization.” The panel noted that Judge Indira Talwani, who was appointed to preside over the MDL, might want to “establish different tracks for the different femoral stems that can be mated with the LFIT device.”
The JPML also found the federal court in Boston was an appropriate location for the MDL since the federal court there is relatively close to HOC’s Mahwah, New Jersey headquarters, where relevant documents and witnesses may be found. In August, Stryker Corporation issued a voluntary recall of certain sizes of its LFIT Anatomic CoCr V40 Femoral Heads made before 2011 after receiving a higher than expected number of complaints of taper lock failure. The taper lock connects the femoral head to the femoral neck. The femoral heads are used on Accolade TMZF and Accolade 2 stems, as well as Meridian and Citation stems. The LFIT V40 femoral head is made of cobalt and chromium. According to Stryker recall hip replacement lawsuits, the implant corrodes to the point of the femoral head coming apart from the femoral stem, which doctors refer to as “spontaneous dissociation.”
