The growing number of talcum powder lawsuits filed in federal courts alleging a link between long-term talcum powder use and ovarian cancer has prompted a federal judicial panel to consolidate the complaints. The U.S. Judicial Panel for Multidistrict Litigation (JPML) issued an order on October 4th to transfer 11 talcum powder cancer lawsuits to the U.S. District Court, District of New Jersey. The wrongful death and personal injury lawsuits contend Johnson & Johnson failed to adequately warn that its Baby Powder and Shower-to-Shower can cause ovarian cancer in women who routinely use the talcum powder products for feminine hygiene purposes. In creating the new multidistrict litigation (MDL), the JPML found the lawsuits have common questions of fact related to the cancer risk posed by talcum powders and whether Johnson & Johnson knew or should have known about the alleged risks. According to the JPML, centralizing the pending cases and talcum powder lawsuits filed in the future will prevent duplicative discovery and inconsistent pretrial rulings from other courts, among other things. Talc is a soft mineral known for its absorbency and ability to protect skin, according to the U.S. Food and Drug Administration (FDA). According to the talcum powder lawsuits, use of talcum-based powders for feminine hygiene over a long term causes talc particles to migrate to the ovaries from the vagina. The complaints allege Johnson & Johnson knew about the ovarian cancer risk but preferred to protect sales of its products instead of warning women about the risk.
Court documents indicate that Johnson & Johnson is facing more than 1,800 talcum powder cancer lawsuits in federal and state courts nationwide. Most claims are filed in St. Louis, Missouri where Johnson & Johnson has lost two talcum powder lawsuit trials. In February, a jury ordered the company to pay $72 million to the family of an Alabama woman who died from ovarian cancer after using Johnson & Johnson’s Baby Powder for 30 years (Talcum Powder Lawsuit Case No. 1422-CC09012-01). In May, a second Missouri jury awarded $55 million to a South Dakota woman who used Johnson & Johnson’s talcum powder for more than 35 years and was diagnosed with stage I ovarian cancer in 2011.
