The firm notes that documents in these testosterone lawsuits indicate that the establishment of multidistrict litigation for testosterone complaints came in the wake of the U.S. Food and Drug Administration’s (FDA) announcement that it was launching an investigation into all FDA-approved prescription testosterone drugs due to the reports of stroke, heart attack and death in men taking testosterone replacement therapy to treat hypogonadism, which is low testosterone levels in men due to a medical condition. According to the testosterone lawsuits, the FDA began its inquiry after reviewing two studies regarding the cardiovascular risks associated with testosterone products. A study published in JAMA in November 2013 found that testosterone products raised the risk of death, heart attack and stroke in men by about 30 percent, according to the testosterone complaints. Also included in the court documents is a study published in PLOS ONE on January 29, 2014 that showed men over 65 years old and men younger than 65 years old with a previous heart condition who were prescribed testosterone medication were at double the risk for heart attacks than men who did not take testosterone replacement therapy. Court records further show that the majority of testosterone lawsuits filed in MDL 2545 are filed against AbbVie and Abbott Laboratories, the makers and marketers of AndroGel. The AndroGel lawsuits allege that the defendants misrepresented the testosterone product as a “safe and effective treatment” for hypogonadism but did not disclose that the medication causes “serious medical problems,” including life-threatening cardiac events, strokes and thrombolytic events. The AndroGel complaints purport that the defendants marketed the product in an “aggressive unbranded disease awareness campaign” to alert men that they might be suffering from “Low T.” As a result of the “disease mongering,” Low T diagnoses have “increased exponentially” and AndroGel’s sales have increased to over $1.37 billion per year, according to the testosterone complaints.
