The three women filed their Taxotere lawsuit in December and allege they suffered permanent hair loss after taking the chemotherapy drug. On April 25, the women filed a motion that asked Judge Kurt D. Engelhardt, who is managing the Taxotere MDL, to certify their putative class-action complaint. The motion stated that women in Louisiana believed to be in the class “are so numerous as to make mass joinder an ineffective tool.” Therefore, certification is the “superior procedural device to handle these cases.” While a multidistrict litigation
manages individual cases in a coordinated manner prior to having separate trials for the cases, a class-action lawsuit, involves one lawsuit with multiple plaintiffs and one trial. Taxotere (docetaxel) was approved in 1996 by the U.S. Food and Drug Administration to treat various forms of cancer including locally advanced or metastatic breast cancer in women whose previous chemotherapy treatments failed. Taxotere is part of a family of drugs known as Taxanes which are widely used as chemotherapy agents. Taxanes block cell growth by interfering with cell division. In addition to hair loss, patients taking Taxotere reported side effects such as anemia, gastrointestinal bleeding, infections, nausea and vomiting, and skin reactions.

The Taxotere MDL was established in October 2016 for all federally filed Taxotere lawsuits. According to the Taxotere Hair Loss complaints, Taxotere has been scientifically linked to causing permanent hair loss and other side-effects. The complaints accuse Sanofi-Aventis and its subsidiaries which manufacture, market and distribute Taxotere, of misleading women to believe that Taxotere was safe, and failed to adequately warn about alopecia. The Taxotere lawsuits further assert that Sanonfi-Aventis marketed Taxotere as more effective than other chemotherapy drugs when other drugs were equally effective without the associated permanent hair loss.
