Johnson & Johnson began its defense last week by presenting testimony from Alan Andersen, a former U.S. Food and Drug Administration scientist and director of the Cosmetic Ingredient Review, who says talcum powder does not carry a cancer risk. Mr. Anderson’s testimony counters testimony from plaintiffs’ expert witnesses, including the plaintiff’s doctor. The experts all stated that J&J’s Talc product can cause ovarian cancer. Also, among plaintiff’s witnesses was Dr. John Godleski, a pathology expert who testified of finding talc particles in the plaintiff’s ovarian tissue samples. This is the first talcum powder cancer lawsuit trial held in California. So far, the majority of trials have been held in the St. Louis Circuit Court in Missouri. The first talcum powder cancer trial ended in February 2016 with a St. Louis jury awarding $72 million to the family of an Alabama woman who died of ovarian cancer in 2015 after decades of genital talcum powder use. About three months later, another jury awarded $55 million to a South Dakota woman diagnosed with ovarian cancer. The verdict was followed in October 2016 with a $70 million award to a California woman. So far, the largest verdict of $110 million was awarded in May when the jury found Johnson & Johnson’s talcum powder products led to the ovarian cancer diagnosis of a Virginia woman in 2012. The woman’s trial was advanced due to her deteriorating health.
The claims presented in this trial mirror those found in 4,800 talcum powder cancer lawsuits filed in state and federal courts nationwide against Johnson & Johnson. The complaints are filed on behalf of women and their survivors who allege the company failed to warn women that long-term genital use of its talcum powder products can cause ovarian cancer.
