U.S. District Judge Eldon Fallon, who is presiding over the Xarelto MDL in the Eastern District of Louisiana, rescheduled the first two bellwether trials to March 13 and April 24, respectively, in New Orleans. The third bellwether trial was reset to May 30, in the Southern District of Mississippi. The fourth trial was initially scheduled for May in Texas but a rescheduling date was not included in Judge Fallon’s order issued on September 21. The first Xarelto bellwether trial was originally scheduled for February 6, 2017, prior to the start of the annual Mardi Gras festival. Parties in the Xarelto MDL asked for the change after the NBA announced in August that New Orleans would host the All-Star Game on February 19. Xarelto (rivaroxaban) is a popular anticoagulant approved by the U.S. Food and Drug Administration (FDA) to prevent strokes, deep vein thrombosis, pulmonary embolism, and blood clots in patients with atrial fibrillation not caused by a heart valve problem. The FDA considers Xarelto a new generation blood thinner compared to warfarin (Coumadin, Jantoven) which received FDA approval over 60 years ago. Bayer touts Xarelto as being more convenient for patients because they do not have to undergo routine blood monitoring like patients taking warfarin. The FDA has pointed out that unlike warfarin, Xarelto does not have an antidote to treat internal bleeding side effects. Warfarin uses vitamin K as a reversal agent for adverse bleeding events.

Court documents show that the first Xarelto trial involves a plaintiff who was prescribed the blood thinner in January 2014 to reduce the risk of stroke due to atrial fibrillation. The plaintiff, however, suffered gastrointestinal bleeding allegedly as a result of taking Xarelto, and had to be hospitalized and have several blood transfusions, according to the Xarelto complaint.
