Xarelto Lawsuit Claims Purporting Uncontrolled Bleeding Continue To Rise

While sales may be growing, the law firm has discovered that Bayer is also seeing a significant growth in the number of lawsuits being filed against the company, with over 600 complaints alleging severe bleeding side-effects and death as a result of using Xarelto. Court documents show that as of May 15, there are over 430 Xarelto complaints pending in the federal litigation established for Xarelto lawsuits in the U.S. District Court, Eastern District of Louisiana. There are nearly 240 cases pending, as of May 15, in a mass tort program established for Xarelto complaints in Pennsylvania’s Philadelphia Court of Common Pleas, according to court records. The Xarelto complaints all allege that Bayer and Johnson & Johnson’s subsidiary, Janssen Pharmaceuticals, which markets the blood thinner, failed to warn doctors and their patients about Xarelto’s potential to cause significant bleeding events and left trauma professionals in hospital emergency rooms without an effective antidote to reverse the anticoagulant’s effects. As stated in court records and the U.S. Food and Drug Administration (FDA), Xarelto was approved by the FDA to reduce the risk of stroke and dangerous blood clots in patients with atrial fibrillation (abnormal heart rhythms) that is not caused by a heart valve problem. According to the FDA, Xarelto is considered a “next generation” blood thinner because it received FDA approval in recent years, compared to warfarin which was approved as a blood thinner in 1954 and is sold under the brand names, Coumadin and Jantoven. Court documents mention that even though warfarin requires patients to undergo regular blood monitoring, the anti-clotting medication has Vitamin K as an antidote should uncontrollable bleeding occur in the patient. Newer blood thinners, such as Xarelto, Eliquis and Pradaxa are marketed as being more convenient to use; however, they do not have a reversal agent to stop the severe bleeding, according to court records and the FDA.

As stated in the Xarelto complaints, the defendants undertook an “intense marketing” campaign of Xarelto that resulted in large profits in the first three months of 2012, one year after Xarelto was approved by the FDA. The Xarelto lawsuits also state that the World Preview reported that Xarelto is estimated to be the “19th best-selling drug in the world by 2018,” with sales expected to jump from $596 million in 2012 to $3.7 billion in 2018. The Xarelto complaints contend that despite the predictions of enormous sales, the blockbuster drug continues to place patients at risk of severe bleeds and death.
