Yamaha Recall Issued After Off-Highway Side-By-Side Vehicles Poses Crash Problems When Water Gets Into The Throttle And Freezes And The Throttle Cannot Return To Idle.

 Yamaha Recall Involves 7,000 Off-Highway Vehicles That Pose Risk of Crash and InjuriesSouthern Med Law is investigating a recent Yahmaha recall of it’s Side-by-Side off-road vehicles. Yamaha Motor Corporation USA is recalling about 7,000 new recreational off-highway vehicles. The recall involves model year 2016 YXZ1000R and YXZ1000R SE Side-by-Side utility vehicles sold in orange and black, blue and white, silver and red, and yellow and white. The vehicles were sold from September 2015 to February 2016 for between $19,800 and $21,600, according to the U.S. Consumer Product Safety Commission (CPSC). This is not the first Yamaha Side-By-Side recall. An earlier recall has resulted in hundreds of Yamaha personal injury lawsuits.

The CPSC explains on its website that “water can get into the throttle cable and if it freezes during cold weather, the ice can prevent the throttle from returning to idle. This can cause the rider to lose control, posing crash and injury hazards.” No injuries or incidents have been reported. The vehicles were made in the United States. The model name and “1000” is displayed in a graphic on both the left and right side of the vehicle.

Yamaha issued a similar recall in March 2008 of about 7,800 of its Side-by-Side Vehicles due to the risk of break failure. The company recalled its 2008 model year Rhino All Terrain Vehicles after serious and fatal injuries were reported shortly after its release. By March 2009, the CPSC had investigated more than 50 incidents involving the Rhino 450, 660, and 700 model off-highway recreational vehicles. The investigation involved 46 driver and passenger deaths associated with the Rhino 450 and 660 models. According to the CPSC, more than two-thirds of the cases were rollovers and many of the occupants were not wearing seat belts. Of the rollover-related deaths and hundreds of reported injuries, some of which were serious, many appeared to involve turns at relatively low speeds and on level terrain.

Court documents reveal that hundreds of Yamaha lawsuits were filed in state and federal courts against the maker over its Rhino off-road vehicles. In 2009, a multidistrict litigation was established in the U.S. District Court, Western District of Kentucky for all federally filed Yamaha Rhino lawsuits. (In re: Yamaha Motor Corp. The largest verdict to date was a $3.3 million award rendered in May 2013 by a Montgomery County, Alabama jury to an Alabama woman who said her arms and legs were severely injured in a Rhino 660 rollover accident.
