Zofran Birth Defect Lawsuit Lawyers Continue Claims That Zofran During Pregnancy Causes Cleft Lip, Cleft Palate, Heart Murmur And Other Birth Defects.

This Zofran lawsuit was filed on behalf of Georgia family whose child was born in 2004 with a cleft palate allegedly due to the mother being prescribed Zofran during her first trimester of pregnancy. Similar Zofran birth defects lawsuits contend that Zofran causes newborns to suffer numerous birth defects such as cleft palate, heart murmur, atrial septal defect (hole in the heart), musculoskeletal defects and other abnormalities.(In Re: Zofran (Ondansetron) Products – Zofran Birth Defects Lawsuit Litigation – MDL No. 2657)

The Zofran birth defects lawsuit states that the child has already undergone various surgeries, including cleft palate repair, a myringotomy which is an incision into the eardrum to relieve pressure or drain fluid, and a sleep study. According to the complaint, the child is expected to undergo more surgeries due to having a “dysmorphic appearance of the mandible” that will require further medical attention as the child grows. The mother maintains that had she known the “truth” about Zofran, which GlaxoSmithKline improperly marketed as a treatment for morning sickness in pregnant women, she would not have taken the drug and her child would have never been injured as the Zofran birth defects complaint described. “Zofran birth defect lawsuits stress that not only are children born with abnormalities, they will have to undergo numerous medical procedures in the future to repair the deformities,” says Dr. François Blaudeau, co-founder of Southern Med Law, which is currently evaluating potential Zofran lawsuits on behalf of families who believe their child was born with a birth defect due to the anti-nausea medication.

Zofran (ondansetron) is an anti-emetic drug approved by the U.S. Food and Drug Administration (FDA) to treat the side effects of nausea and vomiting associated with chemotherapy, radiation, and surgeries. The pharmaceutical giant marketed Zofran to expectant mothers as a treatment for morning sickness. However, GlaxoSmithKline was cited by the federal government for illegally promoting Zofran and its other drugs for uses that were not approved by the FDA. In June 2012, the U.S. Department of Justice (DOJ) announced that GlaxoSmithKline agreed to pay $3 billion to resolve civil and criminal claims filed against the company.

The pending Zofran birth defect claims state that Zofran became “the number one most prescribed drug for treating morning sickness in the United States” in the early 2000s, even though GlaxoSmithKline knew since the 1980s that the drug was unsafe for pregnant women. The company performed animal studies in the mid-1980s that showed Zofran crosses the placental barrier in mammals to expose the fetus to the drug. [ncbi.nlm.nih.gov/pmc/articles/PMC3299087/]

Due to the mounting Zofran birth defects lawsuit claims against GlaxoSmithKline, all federal Zofran claims were consolidated in the Massachusetts federal court in Boston for coordinated pretrial proceedings. The complaints commonly allege that GlaxoSmithKline improperly promoted Zofran as an anti-nausea drug to treat morning sickness in pregnant women resulting in babies suffering from birth defects such as cleft lip, cleft palate and heart defects.
