A recent Zofran birth defects lawsuit has been filed on behalf of an Arkansas mother said her child was born with numerous congenital defects allegedly as a result of her taking Zofran to alleviate morning sickness. Many Zofran birth defects lawsuits are currently pending litigation against Zofran’s maker, GlaxoSmithKline. The complaints contend the pharmaceutical giant failed to disclose the risks of taking the anti-nausea medication Zofran during pregnancy. Zofran lawsuits allege the anti-nausea medication causes newborns to suffer numerous birth defects, including cleft lip, cleft palate, heart murmur, atrial septal defect (hole in the heart), musculoskeletal defects and other abnormalities.(In Re: Zofran (Ondansetron) Products Liability Litigation – MDL No. 2657)
The mother states in her Zofran lawsuit that she was prescribed Zofran early in her first trimester of pregnancy and continued taking it until her third trimester. The lawsuit states the child was born in 2007 with cleft palate, club feet, respiratory distress syndrome and apnea, and has undergone two surgeries to address the defects allegedly caused by Zofran, according to the complaint. The mother said she would have never taken Zofran had GlaxoSmithKline disclosed the birth defects risk and her child would never have been injured. Zofran (ondansetron) is a drug approved by the U.S. Food and Drug Administration (FDA) to treat nausea and vomiting associated with chemotherapy, radiation, and surgery. GlaxoSmithKline promoted Zofran as a medication for expectant mothers who experience morning sickness symptoms, which include nausea and vomiting. The pharmaceutical company, however, was cited by the U.S. Department of Justice (DOJ) for illegally promoting Zofran as a treatment for morning sickness. GlaxoSmithKline agreed to pay $3 billion to resolve civil and criminal claims of improperly marketing Zofran and its other drugs for uses that were not FDA-approved.

Zofran’s prescribing information says there have been “no adequate and well-controlled studies” conducted regarding Zofran use and pregnant women. However, a study on ondansetron use and pregnancy have found that babies exposed to Zofran are born with congenital defects. The study reviewed data, ranging from 1998 to 2012, from the Swedish Medical Birth Register and the Swedish Register of Prescribed Drugs to identify 1,349 infants whose mothers took ondansetron in early pregnancy. The study, published in the Reproductive Toxicology journal in December 2014, found a 62 percent increased risk in cardiovascular defects, most notably a cardiac septum defect.
